Protest At The U.S. Supreme Court to Protect American Inventors And American Innovation

The United States Patent System is in critical condition. The last decade of court decisions, legislation, and management have left inventors without any real protection for their inventions. The number one enemy of inventors is the Patent Trial and Appeals Board (PTAB). The PTAB is a division of the United States Patent and Trademark Office (USPTO) which was formed to adjudicate the validity of patents that have already been issued by the USPTO. Inventors that used to enforce and protect their patent rights in impartial federal courts of law are now being haled into the PTAB which invariably sides with infringers as evidenced by statistics that show that the PTAB invalidates over 90% of the patent claims that it reviews. Now instead of protecting inventions, apparently the primary business of the USPTO now is to help infringers steal inventions by invalidating patents at an alarming rate!
The U.S. Supreme Court seems to have taken notice of the PTAB’s wholesale destruction of patent rights and has agreed to answer the question of whether a patent, which is a property right, can be revoked by a political agency without a judge or jury. In the case Oil States Energy Services, LLC v. Greene’s Energy Group, LLC. Oil States (inventors) will be arguing against Greene’s Energy (infringers) and the USPTO (the patent killing PTAB).
